By accessing or using Calm Mama, you agree to these Terms of Service. The App is operated by Ellen Haines LLC. If you do not agree, please do not use the App.

Agreement to Terms

By accessing or using the Calm Mama application ("the App") available at calmmama.co, you agree to be bound by these Terms of Service. The App is operated by Ellen Haines LLC ("we," "us," or "our").

Description of Service

Calm Mama is a subscription-based audio meditation and mindfulness platform designed for mothers. The App provides guided meditations, breathing exercises, and mindfulness audio content. All audio content is created by humans.

Subscriptions & Billing

Calm Mama offers two subscription plans billed through Stripe:

Monthly: $18/month
Annual: $127/year (save 41%)

Subscriptions auto-renew unless cancelled. You can cancel at any time from your Profile page. Cancellation takes effect at end of the current billing period. Refunds are not provided for partial billing periods.

AI-Powered Features

The App includes an AI-powered audio picker that helps recommend content based on your input. This feature:

Processes your messages in real-time to generate recommendations
Does not store your chat messages
Does not train AI models on your data
Only logs anonymized safety classification metadata (risk level and flags) for user safety purposes

All audio content is human-created. AI is used solely for recommendation matching and safety classification.

User Accounts

You must create an account to use the App. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate information during registration.

Account Deletion

You may delete your account and all associated data from your Profile page within the App. Upon deletion, your personal data, listening history, favorites, badges, and all other account data will be permanently removed.

Mental Health Disclaimer

Calm Mama is not a substitute for professional medical advice, diagnosis, or treatment. Content is for general wellness and relaxation purposes only. Always seek the advice of a qualified healthcare provider regarding any medical or mental health condition.

Crisis Resources

The App provides links to crisis resources including the 988 Suicide & Crisis Lifeline and Crisis Text Line. However, Calm Mama is not a crisis intervention service. If you are experiencing a mental health emergency, call 911 or contact a crisis hotline immediately.

Intellectual Property

All content within the App — including audio recordings, text, graphics, logos, and software — is the property of Ellen Haines LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without prior written consent.

Acceptable Use

You agree not to:

Use the App for any unlawful purpose
Share your account credentials with others
Attempt to reverse-engineer or extract source code from the App
Use automated systems to access the App without permission
Harass, abuse, or harm other users

Limitation of Liability

To the maximum extent permitted by law, Ellen Haines LLC shall not be liable for any indirect, incidental, special, or consequential damages. Our total liability shall not exceed the amount you paid in the twelve months preceding the claim.

Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting updated terms in the App. Continued use after changes constitutes acceptance.

Governing Law

These Terms shall be governed by the laws of the State of Arizona, without regard to conflict of law provisions.
